Dear Reader,
February 2021 was an eventful month for the technology sector in India with the announcement of the latest draft IT Rules for Social Media platforms and OTT & Digital Media. While the rules seem to be well intentioned, they come with their own set of challenges. They reiterate the importance of encryption from both a privacy and national security point of view. This has been explained in this month’s newsletter which includes an in-depth interview with Mr Yashovardhan Azad, Former Secretary (Security) and Special Director, Intelligence Bureau. While the IT rules were timely with the increase in CSAM in India, there is an urgent need to address gender based online violence and this is another subject covered in our wide-ranging newsletter of the month. The Ministry of Electronics and Information Technology (MeITY), last month, announced its draft Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, for social media platforms, Over-the-top players (OTT)and digital media. This comes at a time when there is a significant rise in Child Sexual Abuse Material, misinformation and hate speech. While they are well intended, there are aspects that must be considered in the interest of national security and privacy.

Privacy and free speech as a right have to be persevered for. We cannot leave it for the State and the platform to serve it to us.
The internet, which touches almost all aspects of our lives, is the enabler of not just entertainment, education and business but also of our fundamental right to free speech and right to life.

The Dialogue organized a National Debate Competition on ‘Internet Freedom’ from February 27 and 28 in collaboration with Shaheed Bhagat Singh College, University of Delhi. With the New Intermediary Liability Guidelines being notified only last Thursday, this debate could not have been more timely!
